Rachel O’Donnell (trading under the business name ‘O’Donnell Tax Law’) ABN 67 159 671 301 (O’Donnell Tax Law) is committed to providing quality professional legal services and understands the importance of protecting the privacy of personal information. 

1. Privacy

This Privacy Policy (Policy) explains how O’Donnell Tax Law may collect, hold, use and disclose information that we obtain about you, and your rights in relation to that information. By using our website, services, or otherwise providing us with your information, you acknowledge the terms of this Policy and consent to us collecting, holding, using and disclosing your personal information as described in this Policy.  Please do not send us any of your information if you do not want it to be used in the ways described in this Policy.

In handling your personal information, O’Donnell Tax Law will comply with the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles contained in the Privacy Act.  You can obtain a copy of the Australian Privacy Principles from the website of the Office of the Australian Information Commissioner (www.oaic.gov.au/).  This Policy may be updated from time to time.

2. Personal information

Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable.  During the provision of legal services, O’Donnell Tax Law may collect your personal information, including:

  • contact and professional information, including your name, date of birth, addresses (business, personal and / or postal), email address, phone and fax numbers, and job title);

  • financial information, such as information regarding assets, investments, liabilities, equity, income, expenditure; and

  • other information, including information relating to property interests and titles, directorships and other roles (such as whether you act or have acted as a trustee), family and business relationships, your employment, health conditions, and tax file numbers.

In some circumstances, O’Donnell Tax Law may also hold other personal information provided by you.

3. Collection of personal information

Generally, O’Donnell Tax Law collects your personal information directly from you through discussions and other communications with you, whether in person or via telephone, email, or post.  O’Donnell Tax Law may also collect your personal information from other sources such as from an information services provider, a publicly maintained record (including publicly available information on social media or similar sites), revenue or other government authorities (in connection with your tax affairs), or other professional advisors.

O’Donnell Tax Law will generally only collect your personal information from sources other than you if it is unreasonable or impracticable to collect your personal information from you, or if you have authorised an agent or representative to provide such information to us.

We may also collect and process non-personal information provided to us by your browser when you visit our website or use our applications (for example, the website you came from, your location information, IP address, web browser and/or device type and the time and date of access).  We share this information with Squarespace, our website analytics provider, to learn about site traffic and activity.

4. Purposes for collection of personal information

O’Donnell Tax Law collects, holds, uses and discloses your personal information where it is reasonably necessary for one or more of the following purposes:

  • providing you, or one or more entities with which you are connected, with legal advice and associated services;

  • developing and facilitating a business relationship with you or one or more entities with which you are connected;

  • inviting you to events or functions (whether in person or online, and whether hosted by O’Donnell Tax Law or another person);

  • providing you with updates and publications;

  • marketing, improving, and developing our services, or expanding our business;

  • accounting, billing and other internal administrative purposes;

  • any other legal requirements (including any prescribed by relevant legal profession legislation).

Where personal information is used or disclosed, O’Donnell Tax Law takes steps reasonable in the circumstances to ensure it is relevant to the purpose for which it is to be used or disclosed.  You are not under any obligation to provide your personal information to O’Donnell Tax Law.  However, without certain information from you, O’Donnell Tax Law may not be able to provide services to you.

5. Use and disclosure of personal information

O’Donnell Tax Law discloses your personal information for the purpose for which O’Donnell Tax Law collects it.  That is, generally, O’Donnell Tax Law will only disclose your personal information for the purpose of providing legal services or other purpose set out in part 4 above.  This may include disclosing your personal information to third parties engaged to perform administrative or other business management services.  This disclosure is always on a confidential basis or otherwise in accordance with law.  O’Donnell Tax Law may also disclose your personal information with your consent or if disclosure is required or authorised by law.

6. Access to your personal information

Subject to the exceptions set out in the Privacy Act, you may seek access to and correction of the personal information which we hold about you by contacting us (contact details are provided in part 9 of this Policy).  We will require you to verify your identity and to specify what information you require.  If a fee will be charged for providing access, you will be advised of the likely cost in advance.

7. Security of information

O’Donnell Tax Law takes steps that are reasonable in the circumstances to ensure the personal information we hold is protected from misuse, interference and loss and from unauthorised access, modification or disclosure.

We will take reasonable steps to destroy or permanently de-identify personal information when it is no longer required, unless we are otherwise required or authorised by law to retain the information.  Most personal information is or will be stored in client files which we will keep for a minimum of seven years.

8. Overseas disclosure

Generally, O’Donnell Tax Law is unlikely to disclose your information outside Australia.
